General terms of renting

Scooter at your Hotel, trademark of José Elias Duarte Ventura Lourenço, with registered office at Av. 25 de Abril, Nº 51 5º esq. Torre de Marinha 2840-400 Seixal, rents the vehicle described in the rental agreement (hereinafter referred to as "Vehicle") to the person identified in the rental agreement (hereinafter referred to as "Client") in accordance with the rental terms and conditions described below and/or in any additional attachment that the client has seen and accepted and undertakes to observe and respect on signature of the agreement.

1. Age and Driving Licence Category

The client and driver must be at least 18 years old, hold a valid driving licence, and appropriate experience on a motorcycle of the same size and power as the Vehicle to be rented. It is the responsibility of the Client to ensure that he/she holds a valid driving licence for the Vehicle to be rented.

2. Vehicle Collection and Return

Collection and Return of the Vehicle shall be to the same location at the address, day and time specified in the terms of the rental agreement for the Vehicle. In the event that the Vehicle is returned after the time specified in the agreement, there will be a charge of €10 (ten euros) per hour of delay after the time the Vehicle should have been returned.

On signature of the rental agreement the client shall pay the total cost of the rental and security deposit as specified in the rental agreement (in cash or by credit card). The security deposit shall be returned to the Client or cancelled upon the return of the Vehicle.

Should the client wish to extend the rental period, Scooter at your Hotel must be informed at least 24 hours in advance. Depending upon the availability of the fleet, Scooter at your Hotel may or may not authorize the extension of the rental period.

If the extension of the rental period is not requested and the vehicle is not returned at the address, date and time stipulated in the rental agreement, then this will be considered illegal use of the vehicle and will be reported to the Portuguese authorities.

3. Responsibilities of Scooter at your Hotel

Scooter at your Hotel has to provide the Vehicle in a good state of repair and maintenance and in a safe condition to be driven. The client shall receive all the documentation related to the Vehicle (DUC - single circulation document, and Carta Verde - insurance) as well as the accessories contracted.

Scooter at your Hotel shall verify and record all existing damage to the Vehicle on a form to be handed to the Client on delivery of the Vehicle.

4. Client Responsibilities.

The client is responsible for ensuring that he has a valid driving licence to drive the Vehicle. Driver's licence and identity card or passport must be presented by the client.

The client shall receive the vehicle with the full tank of fuel, and must return the vehicle with a full tank. There will be a surcharge of €15 (15 euros) in the event of return of the Vehicle without a full tank. The Vehicle shall also be returned with all the accessories that received on Collection and contracted for under the specific terms of the rental agreement.

During the rental period, the client is responsible for all fines and violations of the Highway Code or other violations of the law, as well as for any damages caused to the vehicle. Scooter at your Hotel is responsible for providing identification of the Client, or any other information, to the Portuguese authorities whenever requested.

It is the client's responsibility to ensure that the rented vehicle will:

• Be used in accordance with the manufacturer's recommendations

• Be used with full respect for the Highway Code of the country in which it is driven

• Not be used negligently

• Not be used in competitions

• Not be used off-road or on hard shoulders

• Not be used for any illegal purpose

• Not be driven with weight exceeding its authorized capacity

• Not be driven by anyone not listed in the rental agreement

• Not be used if it is deemed mechanically unsafe

• Not be used while under the influence of alcohol, drugs or other narcotic substances

• Not be used if the client's physical condition is weakened by illness or tiredness

Failure to comply with any of the paragraphs above will lead to immediate cancellation of insurance making the client fully liable for the full value of the motorcycle and accessories.

5. Insurance

The following insurance coverage is included in the rental rate are:

• Obligatory Civil Liability Insurance

• Travel Assistance (Continental Portugal)

Damage caused to the vehicle and / or accessories is defined by the deposit in guarantee held by Scooter at your Hotel and specified in the rental agreement.

Insurance does not cover under any circumstance damage to or loss of accessories such as helmets, padlocks etc.

The insurance policy will automatically be considered null and void if:

• The client is involved in an accident and leaves the scene.

• The client does not immediately report the disappearance of the Vehicle to the authorities and to Scooter at your Hotel.

• The Vehicle is involved in an accident and the client does not inform Scooter at your Hotel in the shortest possible time.

• The vehicle is driven by the client and the client is under the influence of alcohol, drugs or other narcotic substances.

• The vehicle is driven in areas not authorized by Scooter at your Hotel such as racing circuits, off national roads or outside the national territory.

• If the client does not meet the requirements stipulated in point 4 that describe the client's responsibilities.

6. Mechanical breakdown

In the event of breakdown, the Client should contact Scooter at your Hotel to provide the exact location and describe as best as possible the nature of the fault. If repair is possible and necessary the client must obtain authorization to proceed from Scooter at your Hotel .

If repair is not possible, Scooter at your Hotel will do everything possible to replace the damaged vehicle in the shortest possible time.

Scooter at your Hotel will reimburse the Client for the time the vehicle is immobilized and, if for any reason the replacement of the vehicle is not possible, Scooter at your Hotel will reimburse the client for all unused days.

Refunds or replacement of the vehicle are excluded if they are caused by accidents or mechanical breakdown caused by a fall or misuse of the Vehicle.

7. I am aware that the vehicle may be equipped with a geolocator device which may be used in case of non-fulfilment of the contract, theft or crossing of national borders.

8. In the event of a dispute between the Client and Scooter at your Hotel, both parties agree to be regulated according to the Portuguese Law. Both the Client and Scooter at your Hotel agree to establish the Court of the District of Lisbon to resolve any disputes arising from the rental agreement with the express exclusion of any other.
